The Tri-Cities Airport Authority (“TCAA”) is offering guest Wi-Fi wireless internet service (the “Service”) according to this Guest Wi-Fi Wireless Network User Agreement & Acceptable Use Policy (the “Agreement”) as a free service to its visitors for the duration of their official visits. All users of this Service must agree to the terms of this Agreement by clicking the ACCEPT button.
Acceptance of Terms & Conditions:
By clicking the ACCEPT button below, you acknowledge and agree that:
- You have read, understand, will comply with and agree to be legally bound by the terms of this Agreement;
- You are at least 18 years of age**; and
- If this Agreement or any terms of the Service are unacceptable or become unacceptable to you, your only recourse will be to terminate your use of the Service.
**If you are under the age of 18, do NOT click ACCEPT. Children may only access the Service after their parents have agreed to the terms of this agreement (by clicking the ACCEPT button).
If you do not agree to the terms of this Agreement, you may not use this Service. Electronic acceptance of the Agreement shall have the same force and effect as if you actually signed the Agreement. The effective date of your acceptance shall be the date you click on ACCEPT below.
TCAA does not guarantee the Service or specific rates of speed. TCAA has no control over information obtained through the Internet and cannot be held responsible for its content or accuracy. TCAA reserves the right to remove, block, filter, or restrict, by any other means, any material that, in its sole discretion, may be illegal, may subject it to liability, or may violate this Agreement. TCAA may cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime. Violations of this Agreement may result in the suspension or termination of access to the Service.
Limitations of Wireless Network Access:
TCAA is not liable for any damage, undesired resource usage, or detrimental effects that may occur to your device and/or software while your device is attached to the Service. You are responsible for any actions taken from your device, whether intentional or unintentional, that damage or otherwise affect other devices or users of the Service. You hereby release TCAA from liability for any claim, claim for relief, loss, damage, security infringement, or injury which the user may have or sustain as a result of being allowed access to the Service. You agree to be solely responsible for any such claim, claim for relief, loss, security infringement, or injury.
You understand that wireless internet access is inherently unsecure; and, you should adopt appropriate security measures when using the Service. We highly discourage you from conducting confidential transactions (such as online banking, credit card transactions, etc.) over any wireless network, including this Service. You are responsible for the security of your own devices.
USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK. TCAA ASSUMES NO RESPONSIBILITY OR LIABILITY WHATSOEVER FOR ANY DAMAGE OR LOSS, OF INFORMATION OR OTHERWISE, WHILE YOU UTILIZE THE SERVICE.
Responsibilities of Service Users:
You are responsible for ensuring that you are running up-to-date anti-virus software on your wireless devices. You must be aware that, as the devices are connected to the internet through the Service, devices are exposed to worms, viruses, Trojan horses, denial-of-service attacks, intrusions, packet-sniffing, and other abuses by third-parties. You must respect all copyrights. Downloading or sharing copyrighted materials is strictly prohibited. The running of programs, services, systems, processes, or servers by a single user or group of users that may substantially degrade network performance or accessibility will not be allowed. Electronic chain letters and mail bombs are prohibited. Connecting to “Peer to Peer” file sharing networks or downloading large files, such as CD ISO images, is also prohibited. Accessing another person’s computer, computer account, files, or data without permission is prohibited. Attempting to circumvent or subvert system or network security measures is prohibited. Creating or running programs that are designed to identify security loopholes, to decrypt intentionally secured data, or to gain unauthorized access to any system is prohibited. Using any means to decode or otherwise obtain restricted passwords or access control information is prohibited. Forging the identity of a user or machine in an electronic communication is prohibited. Saturating network or computer network or computer resources to the exclusion of another’s use, for example, by overloading the network with traffic such as emails or legitimate (file backup or archive) activity or malicious (denial of service attack) activity, is prohibited.
Lawful Use:
The Service may only be used for lawful purposes and in a manner which TCAA believes to be consistent with the rights of other users. The Service shall not be used in a manner which would violate any law or infringe any copyright, trademark, trade secret, right of publicity, privacy right, or any other right of any person or entity. The Service shall not be used for the purpose of accessing, transmitting, or storing material which is considered obscene, pornographic, libelous or defamatory. Illegal acts may subject users to prosecution by local, state, federal, or international authorities. TCAA may bring legal action to enjoin violations of this Policy and/or to collect damages, if any, caused by violations and if suit is filed and TCAA prevails, you will be liable to TCAA for reasonable attorneys’ fees and expenses.
You agree that you will:
- Only use the Service as permitted by applicable local, state, federal and International laws;
- Refrain from any actions that TCAA considers to be negligent or malicious;
- Not send email containing viruses or other malicious or damaging software;
- Maintain appropriate anti-virus and anti-malware software to remove any damaging software from your computer or other electronic devices;
- Not access websites that contain material that is offensive to TCAA, including clear expressions of bigotry, racism, or hatred; and
- Not access websites or transmit materials (by uploading, posting, etc.) that are defamatory, tortuous, threatening, harassing, unlawful, obscene, pornographic, libelous, or abusive.
